If someone were to have stayed longer than their 3 month tourist visa in spain and wanted to take a bus into portugal with a non-EU passport, is there a risk of being caught leaving or entering spain? All advice very much appreciated!

Not at all.There is nothing to worry about. There are NO border control between Spanish and Portuguese roads, I have crossed the border by car a lot of times, I can assure you there is no problem.
